Terms & Conditions

Scope

These Terms and Conditions apply to all business relationships between Intercom IT GmbH and its customers. Deviating or supplementary terms of the customer shall only become part of the contract if expressly agreed in writing.

Conclusion of contract

The presentation of products and services on this website does not constitute a legally binding offer, but an invitation to submit an order. A contract is only concluded when we confirm the order or begin execution of the service.

Prices and payment

All prices are stated in Euro and exclude statutory VAT unless otherwise indicated. Payments are due immediately upon invoicing without deduction unless otherwise agreed.

In the event of default in payment, we reserve the right to charge statutory interest and suspend further services.

Delivery and performance

Delivery dates and service deadlines are non-binding unless explicitly agreed otherwise. Partial deliveries are permitted if reasonable for the customer.

Delays due to force majeure or circumstances beyond our control entitle us to postpone delivery accordingly.

Retention of title

Delivered goods remain our property until full payment has been received. The customer is obliged to treat the goods with care until ownership is transferred.

Warranty

The statutory warranty rights apply. In the case of used goods, warranty claims may be limited to one year unless mandatory legal provisions state otherwise.

Obvious defects must be reported in writing without delay after delivery.

Liability

We are liable without limitation for damages caused by intent or gross negligence. For slight negligence, we are only liable in the event of a breach of essential contractual obligations and limited to foreseeable damages typical for the contract.

Liability for indirect damages, loss of profit or data loss is excluded to the extent permitted by law.

Data protection

Personal data is processed in accordance with applicable data protection laws. Further information can be found in our Privacy Policy.

Place of jurisdiction

The place of jurisdiction for all disputes arising from contractual relationships is the registered office of Intercom IT GmbH, provided the customer is a merchant or a legal entity under public law.

Applicable law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

Final provisions

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose.
